Schedule of Condition saves the day

Richard Brown of NG Chartered Surveyors has acted on behalf of Ace Same Day Couriers as part of their vacation of premises at Castle Donington.

The workshop and office building which Ace had taken on lease three years previously, was subject to a Schedule of Condition prepared by Richard in 2019.

Ace decided to vacate in 2022 and the landlords served a Terminal Schedule of Dilapidations claiming approximately £85,000 + VAT for reinstatement, repair and redecoration works and fees.

Following a comprehensive review of the original Schedule of Condition and acceptance of some roof works which the landlord ultimately undertook, the claim was settled for £20,000; a 75% reduction on the landlords original claim.

The settlement yet again reflects the benefits to tenants of having a well prepared and comprehensive Schedule of Condition attached to their lease to defend against their landlord’s future dilapidations claim.
